Getting Oakland County Court Records

Figure out who holds the file before anything else. For Sixth Circuit work, that means Oakland County Legal Records. That office maintains civil, domestic, felony criminal, business, appeal, and register records. Each Oakland County District Court clerk keeps a separate lower-court file. The Oakland County Probate Court holds its own specialized records. Two tools can point you in the right direction. Court Explorer covers available Sixth Circuit and Probate information, while MiCOURT works statewide. Neither replaces the clerk as custodian.

Oakland County offers several ways in. Court Explorer handles an available online Circuit or Probate register or order. If the display looks incomplete, call or email the correct clerk. Visit the counter for file review or historic research, or use the office's mail route when a trip is not practical. State the court, case number, case type, and the exact product, whether that is a register of actions, plain copy, certified copy, order, or transcript.

  1. Identify the Oakland County court and collect the complete case number, including year and case type.
  2. Choose the right Oakland County route: Court Explorer or MiCOURT to locate a case, the clerk by phone or email, the counter, or mail.
  3. Name the product precisely and include a register date, code, or document description when available.
  4. Ask the Oakland County custodian for the current copy, certification, delivery, and payment requirements.
  5. Keep the receipt and confirm whether the response is a regular copy, certified copy, register view, or transcript.

Oakland County Court Records Custodians

Oakland County splits its clerk duties by court. Legal Records serves as the custodian for Sixth Circuit files. Misdemeanors, traffic and parking matters, small claims, and lower-court civil records sit with the assigned Oakland County District Court clerk. So do preliminary felony materials. Estates, trusts, guardianships, conservatorships, and other probate files stay at Oakland County Probate Court. Send your request to the court that filed the case. Skip the general county office.

Legal Records also lists Court Explorer document assistance at the same phone number. Probate has separate contacts, and a District Court request should go to the division named on the case. Oakland County staff can locate a described record. They cannot provide legal research or legal advice.

Court Record Types

A court record is not one thing. The Register of Actions is a chronological list of filings, hearings, and orders. A filed document might be a complaint, petition, motion, brief, answer, exhibit, order, or judgment. A certified copy is a clerk-certified reproduction. A transcript is different. It is the court reporter's record of a hearing. Each product carries its own purpose, custodian, price, and delivery rule.

  • Register of Actions or docket view, which is the chronological case-event record.
  • Filed pleading or order, such as a complaint, motion, petition, judgment, or signed ruling.
  • Plain copy of an Oakland County record for ordinary reference.
  • Certified copy of an Oakland County court record when certification is required.
  • Transcript of a hearing, which follows a distinct court-reporter request route.

Under Legal Records, Oakland County Circuit covers civil, domestic, felony criminal, business, appeal, and register records. District files stay with their District Court, and probate matters with Probate. Asking for a "court record" without naming the product can slow the search down.

Oakland County Court Records Online Routes

Court Explorer is Oakland County's public window into case and party information, the Register of Actions, and order documents for available Sixth Circuit and Probate cases. Pick the court type and use a case number when you can. Know its limits. It is not the official court record. It excludes PPO, Juvenile, and Probate Mental Health cases, and it may not display every document behind a register entry.

MiCOURT is the statewide route when all you have is a name or a case number. It can identify the court and case number. Then Oakland County Court Explorer takes over for local Circuit or Probate detail. MiFILE exists for filing and service, not public browsing. When an online route comes up short, Oakland County points requesters back to the court clerk, the counter, or the specified document-order process.

Inside an Oakland County Court Record

What sits inside an Oakland County court file depends on the case and the court. Available Court Explorer case pages show a summary. They also offer a print-friendly option and available documents. A register table lists Date, Code, Description, and Order Document columns. A District or MiCOURT result can show a court, case number, and case type. Dates, status, and charge or disposition fields may appear too. Keep the register entry and the document it references separate.

Case numberThe Oakland County identifier used to locate the correct court file, such as YYYY-999999-AA for Court Explorer formats.
Register of ActionsDated case events with a code and description, including filings, notices, hearings, orders, and disposition.
Pleadings and ordersAvailable complaints, petitions, motions, answers, orders, judgments, or other documents behind the register.
CertificationA separate clerk-certified copy request, not merely a printout of a search result.
Transcript or exhibitA distinct record product that can have different access, fulfillment, and custody rules.

An Order Document link can be available without making every filing free or unrestricted. When an Oakland County document does not display, give the clerk the case number, the register date and code, the document name, and whether you need certification.

Oakland County Court Records Request Fields

Request staff in Oakland County need two things. One is an index key. The other is a clear product description. Give the complete case number with its year and case type. Fall back on party names if the number is unknown. Then add the court or division. Include a date, register code, or document description, the delivery method, whether certification is requested, and your contact information. These fields separate a routine copy request from a transcript order or a restricted-record inquiry.

If Court Explorer knows your case number, search there before requesting a document. Review the register, confirm the page count when an order is available, and choose regular or certified copy. Check the delivery and payment information too. When no document link appears, contact Oakland County Legal Records, Probate, or the assigned District Court clerk instead of assuming the document does not exist.

Fees and Certified Copies

Copy fees in Oakland County depend on what you order. Legal Records charges $1 per page for a plain photocopy. Want it certified? That runs $10 per case number plus $1 per page. The certification is its own clerk service. So an emailed copy and a certified copy are two different products. Court Explorer notes that regular copies can be emailed or mailed. Certified copies go out by mail only. Before ordering, confirm the page count, the delivery method, and the final charge.

ItemAmount
Regular photocopy$1 per page
Certified photocopy$10 per case number, plus $1 per page
Court Explorer card service3.5% service fee
Court Explorer ACH service$2.50 service fee

Payment on Court Explorer is by Visa, Mastercard, or Discover. The service charge appears before checkout. All sales are final. Oakland County filing fees sit on a separate schedule from each District Court's own fees. So don't assume a Circuit copy fee applies at another court without checking first.

Oakland County Court Records Transcript Route

Transcripts follow a special Oakland County route once a felony is bound over. Since July 2, 2024, the lower-court felony record turns nonpublic right after bindover. The Sixth Circuit record becomes the one you can see for the Circuit proceeding. A District transcript request after that point is not an ordinary public copy request. Parties and counsel have one route, per Legal Records. They can order the District transcript straight from the District Court. Anyone outside the case should email courtexplorer@oakgov.com instead. The Clerk forwards the inquiry to the reporter or official. Keep the products straight, too. A register, a filed document, a certified copy, and a transcript each have different custodians.

Sealed Records and Public Access

Michigan court records are open by default under MCR 8.119. A law, court rule, or court order can restrict them. Still, Oakland County's online displays leave gaps. Court Explorer excludes PPO, Juvenile, and Probate Mental Health cases. MiCOURT limits or excludes many nonpublic categories. An empty result can mean the wrong court, an older index, a restricted record, or a coverage limit. It does not automatically mean the record is sealed. Protected personal data should never be copied from a public interface. That includes birth dates, Social Security or national-ID numbers, driver or state-ID numbers, passport details, and financial-account numbers. When a record isn't displayed, ask the assigned clerk about the access procedure or a confirmation route. Don't ask staff to disclose protected values.

Michigan court-record rules: MCR 8.119 covers maintenance, inspection, reproduction, and restricted records. MCR 1.109(D)(9) protects personal identifying information. MCR 6.110(G) and MCR 8.119(H)(10) govern the post-bindover felony record route.

Oakland County Court Records Old Files

Older Oakland County records don't always work like a modern online case. The County Clerk holds public records dating to 1820. Probate goes back to 1822. Its counter offers genealogy books and computer access. A historic file might live in a book, a scanned image, or a staff-indexed collection. It may not be a search result at all. So note the court, the approximate date, and any index details before asking staff to search. When an older Circuit or Probate record isn't indexed online, the counter and mail routes still matter. The county's administrative material says case files are reviewed in the Clerk's Office based on space and staff. Files never leave. Don't count on an online PDF for a historic file the county hasn't provided one for.

Oakland County Court Records and Federal Files

An Oakland County address doesn't make every record a county record. Federal cases belong to the United States District Court for the Eastern District of Michigan. It uses its own PACER and CM/ECF routes. A federal docket request or courthouse terminal visit never goes through Oakland County Legal Records. And a county Circuit register won't replace the federal file. The Eastern District of Michigan's Detroit location information shows the federal access setup. It is kept separate from Oakland County court records.

Knowing the federal route keeps an Oakland County court-record request pointed at the right judicial system. When the case is federal rather than a state-court matter, Eastern District of Michigan CM/ECF and PACER information is the official starting point.
